Penalty Notice issued to Richard Crookes Constructions Pty Ltd

On 3 August 2021, the Department issued a $15,000 Penalty Notice to Richard Crookes Constructions Pty Ltd (RCC) for failing to comply with approved construction hours. RCC carried out construction works from approximately 7am to 4pm on Sunday, 20 June 2021 at the Western Sydney University Innovation Hub . The approved construction hours are ‘between 7:00am and 6pm, Mondays to Fridays inclusive; and (b) between 8:00am and 15:00 pm, Saturdays. No work may be carried out on Sundays or public holidays’. This work impacted the amenity of neighbouring residents and resulted in complaints to the Department. The Department will continue to monitor compliance with approved construction hours.
Penalty Notice issued to Roberts Co (NSW) Pty Ltd

On 16 August 2021, the Department issued a $15,000 Penalty Notice to Roberts Co (NSW) Pty Ltd (Roberts Co) for failing to comply with approved construction hours at the Meadowbank Education and Employment Precinct Schools Project. Roberts Co permitted works to occur until 9pm on Wednesday 9 June 2021, causing noise disturbances to neighbouring residents and resulting in several complaints to the Department. The approved weekday construction hours are between 7am and 6pm, or until 7pm provided noise levels do not exceed the existing background noise level by 5 dB, or in an emergency to avoid loss of life, damage to property or to prevent environmental harm, or where works are inaudible at the nearest sensitive receivers. An investigation by the Department found that works on Wednesday 9 June 2021 past 6pm did not meet the above criteria. Compliance with approved construction hours helps to minimise the impact on surrounding residents and protect the amenity of the area.
Penalty Notice issued to Mt Thorley Pty Ltd

On 13 August 2021, the Department issued a $15,000 Penalty Notice to Mt Thorley Pty Ltd (Mt Thorley) for failing to ensure that no mine water is discharged from the Mt Thorley Warkworth mine complex. A rainfall event on 4-6 January 2021 resulted in a mine water dam overtopping and mine water discharging from site. An investigation by the Department concluded that Mt Thorley failed to design and maintain the mine water dams to comply with water management performance measures. Mt Thorley has committed to reviewing their water management infrastructure and their Water Management Plan to ensure no mine water is discharged from site.
Official Caution issued to Roberts Co (NSW) Pty Ltd

Official Caution issued to Warkworth Mining Limited

On 13 August 2021, the Department issued an Official Caution to Warkworth Mining Limited (Warkworth) for failing to design mine water dams to ensure no discharge of mine water off site as required by the Water Management Plan. Following a rainfall event on 4-6 January 2021, mine water discharged from an on-site dam and flowed off site. Warkworth have been reviewing engineering solutions to prevent further off site discharges, following a similar incident in 2019, however, they had not implemented a solution prior to the January 2021 event. The Department is working with Warkworth to expedite a solution and prevent further discharge events.
Official Caution issued to ATB Morton (NSW) Pty Ltd

On 26 August 2021, the Department issued an Official Caution to ATB Morton (NSW) Pty Ltd for failing to submit satisfactory Annual Review reports for the Salt Ash Sand Quarry. Annual Review reports are a key document that allows the Department to review compliance of an operation with its development consent. The Department is working with ATB Morton to improve the quality of information reported in the future Annual Reviews.
Fire Safety Order issued to the owners of Strata Plan 90189 at 1-7 Australia Ave, Sydney Olympic Park

On 9 August 2021, the Department issued Fire Safety Orders to the owners of Strata Plan 90189 at 1-7 Australia Ave, Sydney Olympic Park to remove identified external wall panels on their portion of the building consisting of Aluminium Composite Panels (ACP). ACP is combustible and poses a fire safety risk. The owners are required to replace the ACP with a non – combustible product and provide an inspection report issued by an accredited certifier, certifying that the replacement panels and method of installation comply with the Building Code of Australia. The owners are required to develop and implement fire safety measures to reduce the fire safety risks associated with the cladding until the rectification work is complete.

ACP is combustible and poses a fire safety risk. The owners are required to replace the ACP with a non – combustible product and provide an inspection report issued by an accredited certifier, certifying that the replacement panels and method of installation comply with the Building Code of Australia. The owners are required to develop and implement fire safety measures to reduce the fire safety risks associated with the cladding until the rectification work is complete.
