Penalty Notice issued to Hera Resources Pty Limited

On 18 June 2021, the Department issued a $15,000 Penalty Notice to Hera Resources Pty Limited for failure to carry out the Hera Gold Mine project generally in accordance with the Environmental Assessment and the conditions of consent. Hera carted raw water for operational mining purposes to the mine from offsite sources which was inconsistent with the consent and the Environment Assessment. Hera has scaled its operation to match its available onsite raw water supply and is considering other options, including the construction of additional bores and seeking modification of the consent, to ensure they have an adequate water supply for the project and comply with their legal obligations.

Fire Safety Order issued to the Ultima Harbourside, 25-33 Wharf Street and 37 Bay Street, Tweed Heads

On 18 June 2021, the Department issued Fire Safety Orders to the owners of the Ultima Harbourside at 25-33 Wharf Street and 37 Bay Street, Tweed Heads, to remove identified external wall panels on the building consisting of Aluminium Composite Panels (ACP). ACP is combustible and poses a fire safety risk. The owners are required to replace the ACP with a non – combustible product and provide an inspection report issued by an accredited certifier, certifying that the replacement panels and method of installation comply with the Building Code of Australia. The owners are required to develop and implement fire safety measures to reduce the fire safety risks associated with the cladding until the rectification work is complete.

UPDATE: July 2024 – the works required under this order have now been completed.

Fire Safety Order issued to Strata Plan 73910 at 3 Darling Island Road, Pyrmont

On 7 June 2021, the Department issued Fire Safety Orders to the owners of the Strata Plan 73910 at 3 Darling Island Road, Pyrmont to remove identified external wall panels on the building consisting of Aluminium Composite Panels (ACP). ACP is combustible and poses a fire safety risk. The owners are required to replace the ACP with a non – combustible product and provide an inspection report issued by an accredited certifier, certifying that the replacement panels and method of installation comply with the Building Code of Australia. The owners are required to develop and implement fire safety measures to reduce the fire safety risks associated with the cladding until the rectification work is complete.

On 28 June 2021, the Department issued Fire Safety Orders to the owners of the Strata Plan 76902 at 1-5 Towns Place, Millers Point to remove identified external wall panels on the building consisting of Symonite. Symonite is combustible and poses a fire safety risk. The owners are required to replace the Symonite with a non – combustible product and provide an inspection report issued by an accredited certifier, certifying that the replacement panels and method of installation comply with the Building Code of Australia. The owners are required to develop and implement fire safety measures to reduce the fire safety risks associated with the cladding until the rectification work is complete.
