Penalty Notice issued to Holcim (Australia) Pty Ltd

On 21 May 2021, the Department issued a $15,000 Penalty Notice to Holcim (Australia) Pty Ltd (Holcim) for failure to comply with the approved Biodiversity and Rehabilitation Management Plan during 2019, at their Jandra Quarry. Holcim failed to undertake a pre-clearance survey prior to clearing vegetation within the quarry's disturbance footprint in February 2019 and failed to appropriately monitor and assess rehabilitated areas of the quarry during the 2019 calendar year. The Department will continue to monitor the site to ensure quarrying activities are undertaken in accordance with the approved Biodiversity and Rehabilitation Management Plan to ensure impacts to biodiversity in the area are minimised.
Official Caution issued to Consolidated Power Projects Pty Ltd

On 24 May 2021, the Department issued an Official Caution to Consolidated Power Projects Pty Ltd for the construction of an electrical substation at the Bango Wind Farm project without firstly obtaining a construction certificate as required by the Environmental Planning and Assessment Act 1979. A Building Information Certificate for the substation was subsequently obtained from Yass Valley Council.
Fire Safety Orders issued to the Bellflower, Magnolia and Jacaranda buildings at the Cardinal Freeman Retirement Village, Ashfield

On 6 May 2021, the Department issued Fire Safety Orders to the owners of the Bellflower, Magnolia and Jacaranda buildings (Buildings 2, 3 and 4) at the Cardinal Freeman Retirement Village, 137 Victoria Street and 4-6 Clissold Street, Ashfield, to remove identified external wall panels on the buildings consisting of Aluminium Composite Panels (ACP). ACP is combustible and poses a fire safety risk. The owner is required to replace the ACP with a non – combustible product and provide inspection reports issued by an accredited certifier, certifying that the replacement panels and method of installation comply with the Building Code of Australia. The owner is required to develop and implement fire safety measures to reduce the fire safety risks associated with the cladding until the rectification works are complete.
UPDATE: June 2023 – the works required under this order have now been completed.
Development Control Order issued to the Logos Properties Holdings Pty Ltd (Logos)

On 25 March 2021, the Department issued a Development Control Order to Logos Properties Holdings Pty Ltd (Logos) to undertake additional attended noise monitoring to prepare a new Noise Validation Report for their Marsden Park warehouse development. Logos had previously submitted a Noise Validation Report to the Department based on inadequate noise monitoring, failing to take account of enhancing weather conditions and worst-case operational scenarios. Logos have since engaged a noise consultant and carried out the required noise monitoring.
Development Control Order issued to Capra Development Pty Ltd

On 17 May 2021, the Department issued a Development Control Order to Capra Developments Pty Ltd (Capra) to remedy a breach of the consent for failing to retire ecosystem credits required to offset vegetation removed to facilitate the construction of their Bourke Small Stock Abattoir. The Order requires Capra to retire the required ecosystem credits by 30 June 2022.

On 19 May 2021, the Department issued a Fire Safety Order to the owners of the University of Sydney - Building H69: Business School Building, 21-25 Codrington Street, Darlington, to remove identified external wall panels on the buildings consisting of Aluminium Composite Panels (ACP). On 28 May 2021, the department issued a Fire Safety Order to the owners of 3 Lime Street, Sydney NSW 2000, to remove identified external wall panels on the building consisting of Aluminium Composite Panels (ACP) and Timber Panels. ACP and Timber Panels are combustible and pose a fire safety risk. The owners are required to replace the ACP and Timber Panels with a non-combustible product and provide an inspection report issued by an accredited certifier, certifying that the replacement panels and method of installation comply with the Building Code of Australia. The owners are required to develop and implement fire safety measures to reduce the fire safety risks associated with the cladding until the rectification work is complete.
