Penalty Notice issued to East Land 5 Pty Ltd

(MP06_0243) Tweed Shire LGA

On July 23, 2024, NSW Planning issued a $6,000 Penalty Notice to East Land 5 Pty Ltd (East Land 5) for failing to comply with the terms of a Development Control Order (the Order) issued on 16 February 2024. The Order required East Land 5 to repair and maintain on-site sediment and erosion controls within specified timeframes. East Land 5 has since complied with the Order’s requirements.

Penalty Notice issued to Lipman Pty Ltd

(SSD-7942) City of Parramatta LGA

On 16 July 2024, NSW Planning issued a $15,000 Penalty Notice to Lipman Pty Ltd (Lipman) for carrying out construction at the Open Water Surf Facility at Sydney Olympic Park outside of the approved construction hours of 7am-5pm Mondays to Saturdays. On Thursday 28 March 2024, Lipman commenced a concrete pour at approximately 5:40 pm outside the approved construction hours. The construction of the Open Water Surf Facility is now complete.

Penalty Notice issued to Lipman Pty Ltd

(SSD-7942) City of Parramatta LGA

On 16 July 2024, NSW Planning issued a $15,000 Penalty Notice to Lipman Pty Ltd (Lipman), for obstruction of the public way with heavy vehicles (Holker Busway, loop road, bicycle path and pedestrian pathway) at the Open Water Surf Facility on 11 March 2024 in breach of the consent. The  obstruction of the public way resulted in a complaint to NSW Planning and movement of cyclists from the bicycle path onto the road. The construction of the Open Water Surf Facility is now complete.

Penalty Notice issued to CPB Contractors Pty Limited

(SSD-10376) City of Sydney LGA

On 2 July 2024, NSW Planning issued a $15,000 Penalty Notice to CPB Contractors Pty Limited for carrying out construction outside of the approved construction hours at the Pitt Street South Over Station Development (Project). NSW Planning will continue to monitor compliance with conditions of consent as the project nears completion.

Penalty Notice issued to Gamuda Berhad

(SSI-10038) City of Parramatta LGA

On 23 July 2024, NSW Planning issued a $15,000 Penalty Notice to Gamuda Berhad (Gamuda) for failing to ensure effective noise mitigation was in place at the Westmead station construction site for out of hours compressor noise. Gamuda commissioned a pair of compressors in June 2023 and identified compressor related noise exceedances in the night period in August 2023, however, did not initiate effective mitigation until November 2023. Gamuda has since had custom silencers fitted to the compressors to reduce noise impacts.
