Enforceable Undertaking accepted from Bellevarde Constructions Pty Ltd

On 12 June 2024, NSW Planning accepted an Enforceable Undertaking (EU) from Bellevarde Construction Pty Ltd (Bellavarde). Bellevarde undertook activities between December 2021 and January 2022 at Black Bear Inn, Diggins Terrace, Thredbo Village which were contrary to the development consent. Bellevarde conducted necessary actions to stabilise the site and subsequently sought the necessary approvals. The EU requires Bellevarde to deliver awareness and training to industry groups within the Alpine Region. Further details can be found on the signed enforceable undertaking (PDF, 1 MB).

Penalty Notice issued to Multiplex Constructions Pty Ltd

(SSD-8925) City of Sydney LGA

On 27 June 2024, NSW Planning issued a $15,000 Penalty Notice to Multiplex Constructions Pty Ltd (Multiplex) for carrying out construction activities at the New Sydney Fish Market development outside of the approved construction hours on 13 March 2024. Multiplex have since recommunicated the approved construction hours to members of the project team and NSW Planning will continue to monitor the development.

Penalty Notice issued to Dunmore Sands and Soil Pty Ltd

(DA195-8-2004) Shellharbour City LGA

On 26 June 2024, NSW Planning issued a $15,000 Penalty Notice to Dunmore Sands and Soil Pty Ltd (DSS) for failing to submit a recalculated Conservation and Rehabilitation Bond within 6 months of Modification 2 being approved for the Dunmore Lakes Quarry Project. DSS have subsequently recalculated the bond amount and NSW Planning approved the calculated bond amount on 18 December 2023.

Official Caution issued to Ferrycarrig Constructions Pty Ltd

(SSD-8925) City of Sydney LGA

On 13 June 2024, NSW Planning issued an Official Caution to Ferrycarrig Constructions Pty Ltd for failing to properly implement tree protection measures at the New Sydney Fish Markets project resulting in a tree located within the public domain being impacted. As a result of the poor health of the tree, Ferrycarrig liaised with the City of Sydney Council for a replacement tree to be planted.

Development Control Order issued to ESR Developments (Australia) Pty Ltd

(SSD-9138102) Penrith LGA

On 18 June 2024, a delegate for the Minister for Planning issued a Development Control Order to ESR Developments (Australia) Pty Ltd (ESR) in relation to development at 200 Aldington Road, Kemps Creek. Under the Order, ESR is refrained from carrying out work in the area identified as ‘undeveloped land’ in the consent.
