Development Control Order issued to North Construction and Building Pty Ltd

On 12 November 2024, the NSW Planning issued a Development Control Order (Order) to North Construction and Building (North Construction) to remove soil that was being stockpiled in breach of conditions of consent. The terms of the Order require North Construction to either move the incorrectly stockpiled soil to approved locations and implement appropriate erosion/sediment and weed controls, or lawfully dispose of the soil. NSW Planning will continue to monitor compliance with conditions of consent.
Penalty Notice issued to Richard Crookes Constructions Pty Ltd

On 19 November 2024, NSW Planning issued a $15,000 Penalty Notice to Richard Crookes Constructions Pty Limited (RCC) for failing to implement the approved Construction Traffic Management Plan (CTMP) at the Westlink Industrial Estate – Stage 1 development. On 4 June 2024, RCC failed to distribute the approved traffic routes to drivers prior to their arrival at the site in contravention of the CTMP. The approved traffic routes were put in place to improve road safety and amenity by avoiding a local school and other sensitive land uses, providing a safer option for vehicles leaving and entering Mamre Road. NSW Planning will continue to monitor compliance with the approved traffic routes at the development.
Penalty Notice issued to Hanson Construction Materials Pty Ltd

On 28 November 2024, NSW Planning issued a $15,000 Penalty Notice to Hanson Construction Materials Pty Ltd (Hanson) for extraction of quarry materials outside of the approved extraction boundary of Cell 2 at the Wagga Wagga Quarry. Compliance with extraction boundaries ensures that any impacts to the natural environment have been assessed and if required, offset. NSW Planning will continue to monitor compliance with conditions of consent.
Penalty Notice issued to Cadia Holdings Pty Ltd

On 28 November 2024, NSW Planning issued a $15,000 Penalty Notice to Cadia Holdings Pty Ltd (CHPL) for failing to implement the Water Management Plan (WMP) for Cadia East Project. Cadia self-reported the non-compliance following an internal review and an independent report identified that various dams on site were not to the capacity identified in the WMP. NSW Planning will continue to monitor compliance with conditions of consent.
Penalty Notice issued to Wollongong Resources Pty Ltd

On 29 November 2024, NSW Planning issued a $15,000 Penalty Notice to Wollongong Resources Pty Ltd (Wollongong Resources) for failing to undertake surface and groundwater monitoring during 2023 and early 2024 at Russell Vale Colliery as required by the approved Water Management and Extraction Plans. Wollongong Resources have engaged a consultant to undertake monitoring and have implemented measures to ensure compliance with their management plans.
Official Caution issued to Armidale Regional Council

On 11 November 2024, NSW Planning issued an Official Caution to Armidale Regional Council for failing to submit Annual Reviews for the Armidale Waste Facility which commenced operation in 2020. Armidale Council have since submitted an Annual Review and NSW Planning will continue to monitor the project to ensure compliance with conditions of consent.
Official Caution issued to Griffith City Council

On 19 November 2024, NSW Planning issued an Official Caution to Griffith City Council for exceeding the approved annual waste to landfill limit for the Tharbogang Quarry and Waste Facility. NSW Planning will continue to monitor the project to ensure compliance with conditions of consent.
Official Caution issued to CJ Doyle Contracting Services Pty Ltd

On 20 November 2024, NSW Planning issued an Official Caution to CJ Doyle Contracting Services Pty Ltd (CJ Doyle) for failing to implement the approved Construction Traffic Management Plan (CTMP) at the 200 Aldington Road Industrial Estate development. A CJ Doyle truck was identified turning right from Abbotts Road onto Mamre Road in contravention of the approved traffic routes. NSW Planning will continue to monitor compliance with the approved traffic routes at the development.
Official Caution issued to Simmons Civil Contracting Pty Ltd

On 21 November 2024, NSW Planning issued an Official Caution to Simmons Civil Contracting Pty Ltd (Simmons Civil) for failure to implement the approved Construction Environmental Management Plan (CEMP) at the 200 Aldington Rd Industrial Estate. While dewatering a dam, sediment laden water was discharged off site. Simmons Civil have since changed their dewatering procedure to ensure this type of incident does not occur.
