Official Caution issued to POK Holdings Pty Ltd

(SSD-9138102) Penrith LGA

On 10 September 2024, NSW Planning issued an Official Caution to POK Holdings Pty Ltd (POK Holdings) for failing to implement the approved Construction Traffic Management Plan (CTMP) at the Westlink Industrial Estate – Stage 1 development. On 3 July 2024 a truck owned by POK Holdings was identified turning right from Abbotts Road onto Mamre Road in contravention of the approved traffic routes. The requirement for the left turn into and out of Abbotts Road was put in place for safety and local amenity reasons until the signalised Mamre/Abbbots Road intersection is constructed. NSW Planning will continue to monitor compliance with the approved traffic routes at the development.

Penalty Notice issued to Concrite Pty Ltd

(SSD-10479) Penrith LGA

On 10 September 2024, NSW Planning issued a $15,000 Penalty Notice to Concrite Pty Ltd (Concrite) for failing to implement the approved Construction Traffic Management Plan (CTMP) at the 200 Aldington Road Industrial Estate development. Concrite failed to provide the CTMP (containing the approved traffic routes) to their subcontractor resulting in a heavy vehicle subcontracted by Concrite turning right from Abbotts Road onto Mamre Road in contravention of the approved traffic routes on 21 June 2024. The requirement for the left turn into and out of Abbotts Road was put in place for safety and local amenity reasons until the signalised Mamre/Abbbots Road intersection is constructed. NSW Planning will continue to monitor compliance with the approved traffic routes at the development.

Enforceable Undertaking accepted from AW Edwards Pty Limited

(SSI-7400) North Sydney LGA

On 13 September 2024, NSW Planning accepted an enforceable undertaking from AW Edwards Pty Limited (AWE) for failing to comply with conditions of approval at the Sydney Metro (SSI-7400) Crows Nest station site. On occasion during station construction, the work location differed from the specific location that was approved for out of hours work, or that was notified to residents for interrupted property access. Additionally, environmental compliance was not audited on a quarterly basis. AWE has undertaken to offer monetary grants during the 2024/25 financial year, to a maximum aggregate value of $40,000, for the benefit of the Crows Nest community. Penalty Notice issued to North Construction and Building Pty Ltd

(SSD-8989) Port Stephens LGA

On 13 September 2024, NSW Planning issued a $15,000 Penalty Notice to North Construction and Building Pty Ltd, for failing to undertake development in accordance with the approved Stormwater and Civil Plans for the Catherine McAuley Catholic College development by stockpiling soil in unapproved locations. NSW Planning are working with North Construction & Building Pty Ltd to resolve the issue.

Official Caution issued to North Construction and Building Pty Ltd

(SSD-8989) Port Stephens LGA

On 13 September 2024, NSW Planning issued an Official Caution to North Construction and Building Pty Ltd, for carrying out construction work within a Tree Protection Zone (TPZ) without the supervision of a qualified arborist. North Construction and Building Pty Ltd have since committed to better management measures and additional training for staff to ensure all work within TPZs is managed in accordance with the conditions of development consent and relevant management plans.

On 24 September 2024, NSW Planning issued an Official Caution to Pro Equipment Australia Pty Ltd (Pro Equipment Australia) for failing to implement the approved Construction Traffic Management Plan (CTMP) at the 200 Aldington Road Industrial Estate development. On 27 June 2024 a truck owned by Pro Equipment Australia was identified turning right from Abbotts Road onto Mamre Road in contravention of the approved traffic routes. The requirement for the left turn into and out of Abbotts Road was put in place for safety and local amenity reasons until the signalised Mamre/Abbbots Road intersection is constructed. NSW Planning will continue to monitor compliance with the approved traffic routes at the development.

Official Caution issued to Hansen Yuncken Pty Ltd

(SSD-47749715) Central Coast LGA

On 26 September 2024, NSW Planning issued an Official Caution to Hansen Yuncken Pty Ltd (Hansen Yuncken) for failing to comply with the approved construction hours at the University of Newcastle Central Coast Campus development. On 1 August 2024 Hansen Yuncken conducted concreting works outside of the approved construction hours (until 11.30pm). Hansen Yuncken showed remorse during the investigation and have committed to comply with the approved construction hours in the future.
